All obligations incurred prior to termination survive the termination of this agreement.

These Terms of Service, together with any posted policies, constitute the entire agreement between you and us.

These Terms are governed by the law of England and Wales. If you are a consumer, you benefit from any mandatory consumer-protection provisions of the country in which you live — including, for customers in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 — and nothing in these Terms prevents you from bringing proceedings, or relying on those protections, in your home jurisdiction.

SECTION 20 - PRE-ORDERS AND DELIVERY

Some products are offered on a pre-order basis. Where you place a pre-order, the following applies in addition to the rest of these Terms.

1. Estimated delivery. Any delivery date or window we give for a pre-order — including any date shown on the product page, in your order confirmation, or in our Shipping policy — is an estimate made in good faith and is not a guaranteed delivery date. Our products are assembled to order, and estimates depend on component supply, manufacturing and shipping.

2. Changes to the estimate. If the estimated delivery window changes materially, we will tell you by email as soon as reasonably practicable and give you a revised estimate.

3. Time is not of the essence. Unless we have expressly agreed a firm delivery date with you in writing, time for delivery is not of the essence of the contract.

4. Events outside our reasonable control. We are not responsible for delays caused by events outside our reasonable control, including supplier or component delays, manufacturing interruptions, transport or carrier delays, industrial action, regulatory or certification requirements, or acts of God. Where such an event occurs, the estimated delivery window is extended by a reasonable period and we will keep you informed.

5. Your right to cancel a pre-order. You may cancel a pre-order at any time before dispatch and receive a full refund, with no collection fee. If delivery is delayed beyond a reasonable period, you may set an additional reasonable period for delivery, and if we do not deliver within it you may cancel the order and receive a full refund. These rights are in addition to, and do not affect, your statutory rights — including your right to cancel within 14 days of receiving the goods.

6. Price. The price of your pre-order is fixed at the date you place your order. If our prices change afterwards, the price you paid is not affected.

7. What your payment is used for. Pre-order payments contribute directly to funding the production run of the products ordered.

8. Nothing in this section limits our liability where it would be unlawful to do so, or affects your rights under the Consumer Rights Act 2015 or, for customers in the EU, equivalent consumer protection law.
